Terms and Conditions


1. Applicability
1.1. These General Terms and Conditions apply to all agreements between Blackwood Tables and the customer (hereinafter referred to as "Buyer") with regard to the purchase of tables via the Blackwood Tables website.
1.2. By using the Blackwood Tables website and placing an order, the Buyer fully and unreservedly accepts these General Terms and Conditions.


2. Offer and order
2.1. All offers and prices on the Blackwood Tables website are without obligation and subject to changes and printing errors.
2.2. An agreement is concluded at the moment that Buyer places an order on the Blackwood Tables website and this order is confirmed.
2.3. Blackwood Tables has the right to refuse orders or impose additional conditions, for example in the event of insufficient stock or suspected abuse.


3. Prices and payment
3.1. The prices on the Seller's website are in Euros, including VAT and excluding any shipping costs, unless stated otherwise.
3.2. Payment must be made via the payment options offered on the Blackwood Tables website.
3.3. If payment is not received on time, Blackwood Tables has the right to cancel the order.
3.4. In the event of payment arrears, the Buyer shall owe interest and collection costs in accordance with the statutory regulations in the Netherlands.


4. Delivery
4.1. Blackwood Tables will execute the order with the utmost care and strive for a fast delivery. However, the stated delivery times are indicative and cannot be guaranteed.
4.2. Blackwood Tables is not liable for any damage resulting from delay in delivery.
4.3. The risk of damage and/or loss of the ordered products shall pass to the Buyer at the time of delivery.


5. Returns and right of withdrawal
5.1. Buyer has the right to return the order within 14 days after receipt, without giving any reason. Provided that the product has not been custom made or treated.
5.2. Returns must be reported in advance to Blackwood Tables via the contact details on the Seller's website. This can be done via info@blackwoodtafels.nl
5.3. The costs for return shipment are for the account of the Buyer, unless otherwise agreed.
5.4. Products must be returned in their original condition and packaging.
5.5. Blackwood Tables will refund the purchase amount (excluding any shipping costs) to the Buyer within 14 days of receipt of the return shipment.


6. Warranty
6.1. Blackwood Tables guarantees the quality of the delivered products and guarantees that the products meet the usual requirements and standards that can be set for them.
6.2. Buyer must check the delivered products upon receipt for any defects and inform Seller of this in writing as soon as possible, but no later than 14 days after receipt. This can be done via info@blackwoodtafels.nl
6.3. If a product is defective, Buyer is entitled to free repair or replacement of the product, at Seller's discretion. The warranty period is 1 year after receipt of the product.

At Blackwood Tables, we attach great importance to the quality of our wooden components. That is why we offer a limited warranty that only applies to demonstrable production defects. Natural properties of wood, such as the 'working' of the material, are not covered. This concerns phenomena such as shrinking, expanding, warping or cracking - all normal reactions of wood to changes in its environment. Wood is a natural product that continues to react to changes in temperature and humidity. Our wood is carefully sawn and dried to a moisture content of 8% to 12%, making it suitable for use in heated indoor spaces. However, it remains sensitive to fluctuations in humidity: it absorbs moisture at high humidity and releases it again when the air becomes drier. In order to minimize the chance of the wood working, we recommend that you keep the humidity in your home as stable as possible. An ideal humidity is between 50% and 60%. In winter, a slightly lower value (around 40%) is acceptable, while in summer this can increase to around 70%.

6.4. The warranty shall lapse if the defects are caused by incorrect use, injudicious or careless actions by the Buyer, or if the Buyer has made changes to the product himself.


7. Liability
7.1. Seller shall not be liable for any damage, direct or indirect, suffered by Buyer or third parties as a result of the use of the delivered products, unless there is intent or gross negligence on the part of Seller.
7.2. The Seller's liability is in any case limited to the amount of the purchase price of the product in question.
7.3. The buyer is responsible for the correct use and maintenance of the delivered products, as described in the accompanying instructions.


8. Intellectual property rights
8.1. All intellectual property rights, such as copyrights and trademark rights, relating to the products and the website of Seller, remain the property of Blackwood Tables or its licensors.
8.2. The Buyer is not permitted to use these intellectual property rights without the prior written consent of Blackwood Tables, including but not limited to copying, distributing, or otherwise reproducing or making public (parts of) the website or the products.


9. Force Majeure
9.1. In the event of force majeure, such as but not limited to strikes, fire, transport problems, government measures, disruptions in electronic communication and unavailability of the Blackwood Tables website, Blackwood Tables is not obliged to fulfil any obligation towards the Buyer.
9.2. If the force majeure situation lasts longer than 30 days, both parties have the right to terminate the agreement without any obligation to pay damages.


10.Privacy and personal data
10.1. Blackwood Tables will process the Buyer's personal data in accordance with applicable privacy legislation and its privacy policy, as published on the website.
10.2. Blackwood Tables will only use the Buyer's personal data for the execution of the agreement and the sending of the ordered products, unless the Buyer has given express permission for other purposes.
10.3. Blackwood Tables will not provide the Buyer's personal data to third parties, unless this is necessary for the performance of the agreement or on the basis of legal obligations.


11. Complaints procedure
11.1. If Buyer has a complaint about the delivered products or the services provided by Blackwood Tables, Buyer must report this complaint in writing as soon as possible, but no later than 14 days after discovering the complaint.
11.2. Blackwood Tables will handle the complaint as soon as possible, but no later than 30 days after receipt, and attempt to reach a solution in consultation with the Buyer. 11.3. If the complaint cannot be resolved by mutual agreement, a dispute will arise that can be submitted to the competent court.


12. Applicable law and disputes
12.1. These general terms and conditions and the agreement between Buyer and Seller are exclusively governed by Dutch law.
12.2. Disputes between Buyer and Blackwood Tables will be submitted to the competent court in the district in which Blackwood Tables is established.
